Zimmer Biomet Wins First Bellwether Trial in NexGen Knee Implant Litigation

Zimmer Biomet secured its first multidistrict litigation victory in defense of the company’s NexGen Flex knee implants. After a nearly four-week trial, a federal jury in Chicago found that that Zimmer’s design was not negligent, nor did the company fail to warn the surgeon performing the plaintiff’s double knee replacement. This is especially noteworthy because the case was a “bellwether” trial that the plaintiffs hand-picked to be the first case tried. On behalf of Zimmer in the NexGen Flex MDL, FaegreBD has excluded a number of key expert opinions and legal theories, in addition to securing the dismissal of more than 400 cases in the last 18 months.
