LifePort Sciences LLC v. W.L. Gore & Associates

Europe - Germany | United States - Delaware

LifePort is a patent assertion entity with thousands of patents in its portfolio. LifePort launched a global litigation offensive against Gore alleging infringement of thirteen U.S. patents and three European patents. The U.S. component of this litigation was before Judge Sleet in the District of Delaware: federal case number 1:12-CV-01792.

Over the next several years, our firm helped Gore stage an aggressive counter-offensive, which included multiple requests for inter partes review at the U.S. Patent Office, counterclaims for both inequitable conduct and deceptive trade practices, and aggressive defense of all pending actions against Gore. After achieving a series of successful outcomes on the European patents in Germany, having multiple inter partes reviews successfully instituted, and a highly effective Markman hearing, Gore was able to leverage a favorable settlement in 2016.
