National Bank Wins Dismissal in FLSA Collective Action and Wage Payment Class Action

A national bank successfully defended against a multi-plaintiff FLSA collective action and Iowa wage payment class action claims brought by customer service employees. Our firm represented the national bank, whose motion to dismiss was granted in part, with the ruling holding that federal law preempted recovery under the Iowa Wage Payment Collection Law and, even if it did not, state law would not permit recovery against supervisory employees.  The parties subsequently entered in a settlement agreement and filed for dismissal with prejudice in February 2016.
