Ethanol Distributor Wins Seventh Circuit Appeal

Ethanol distributor Aventine Renewable Energy, Inc. won a reversal in the Seventh Circuit Court of Appeals after the underlying court found in favor of Glacial Lakes Energy related to a dispute of unpaid accounts under a 2009 termination agreement between the parties. Our firm represented Aventine in the litigation.

Aventine went through bankruptcy and then sued Glacial for unpaid fees under the termination agreements in Illinois state court. However, all parties agreed the case should be governed by New York law and, as such, the underlying court's ruling of summary judgment in Glacial's favor could not stand. Upon appeal, the judgment of the district court was reversed and Glacial was ordered to pay the money due to Aventine.
