Cook Medical Litigates National MDL Involving IVC Filter

Cook Medical is litigating multidistrict litigation involving its inferior vena cava (IVC) filter product. Faegre Baker Daniels is representing Bloomington, Indiana-based Cook as national counsel in this matter, which involves Cook's Gunther Tulip and Celect IVC filter products.

A federal district court granted summary judgment in favor of Cook in Arthur Gage v. Cook Inc., the second bellwether case in the MDL involving Cook’s inferior vena cava (IVC) filters. The decision marked the second straight win for Cook in the litigation’s bellwether cases, which were selected by the Court to test the legitimacy of the plaintiffs’ claims.  In the first and only other bellwether test case just a few months ago, Elizabeth Hill v. Cook Medical LLC, a jury in Evansville, Indiana, unanimously determined that the plaintiff failed to prove a defect in another of Cook’s IVC Filters, the Cook Celect Filter.  To date, Cook’s victories in the Gage and Hill cases are the only decisions reached on the merits in the Cook IVC Filter litigation.
