Indiana Farm Challenges Federal Jurisdiction Finding Under Clean Water Act

Under the "Waters of the United States" (WOTUS) rule regarding federal jurisdiction under the Clean Water Act, the Army Corps found federal jurisdiction at a farm in Indiana. Our firm represented the Indiana farm and helped the client successfully appeal the Army Corps finding of federal jurisdiction.

The federal jurisdiction finding would have required the client to spend potentially millions of dollars in permits for the farm's fields and penalties. The case has been remanded back to the Army Corps for reconsideration.
