Two Fortune 500 manufacturing companies worked with Faegre Baker Daniels' employment counseling and compliance team to evaluate the post-offer, pre-hire physical testing and selection procedures of certain roles for defensibility of job-simulation functional capacity evaluations against potential disparate impact challenges. In one circumstance, FaegreBD provided case reviews and assessments of the defensibility of a validation study report provided by an industry subject matter expert.
