COVID-19 and Design Defect Jurors’ Risk Evaluations

Product liability and mass torts partner Del Ehrich, senior counsel Joe Price, associate Andrew Jackson, and Jill Leibold, Ph.D., shareholder and director of jury research at Litigation Insights and Merrie Jo Pitera, Ph.D., CEO and director of jury research at Litigation Insights, have coauthored the article “COVID-19 and Design Defect Jurors’ Risk Evaluations” for Law360.

The article looks at the key role risk that assessment plays in complex product liability/design defect cases, but more importantly, how the COVID-19 pandemic added to, and potentially altered, the risk profiles of potential jurors. In the three-part article, the authors review factors that should be considered and evaluated as part of jury research in a design-defect case in the post-pandemic world.
