Overview

Nury Yoo helps clients in the food and beverage, fresh produce, cosmetics, dietary supplement, OTC drug, personal care, medical device, restaurant, and alcohol beverage industries to navigate regulations, anticipate and manage risk, and defend against challenges. Her areas of focus include regulatory compliance, labeling, claims and substantiation, marketing and advertising, food safety, product recalls, due diligence reviews for private investment, consumer and competitor challenges, and California’s Proposition 65. She also advises clients on the complex federal and state issues in the use of cannabidiol (CBD) and related cannabinoids in consumer products.

As a litigator, Nury represented clients in state and federal trial and appellate courts. Clients now seek her counsel on litigation risk analysis and management, negotiation of pre-dispute demands, and strategy in active litigation.

Nury represents clients in areas regulated by the U.S. Food and Drug Administration (FDA), U.S. Department of Agriculture (USDA), Federal Trade Commission (FTC), Alcohol and Tobacco Tax and Trade Bureau (TTB), and state regulatory agencies such as California’s Office of Environmental Health Hazard Assessment (OEHHA) and Department of Public Health (CDPH). She is also experienced in the consumer product arena before the U.S. Consumer Product Safety Commission (CPSC), advertising challenges before the BBB National Programs’ National Advertising Division (NAD), and food-related intellectual property matters before the Trademark Trial and Appeal Board (TTAB) of the U.S. Patent and Trademark Office.

Product Development, Marketing & Advertising

Nury advises on the development of products and integration of ingredients, including labeling, formula review, regulatory status and claims substantiation. She provides regulatory and litigation risk assessments of labeling, advertising, marketing, and social media materials and campaigns. She also collaborates with clients to evaluate claims (such as nutrient content, health, structure/function, environmental marketing, corporate social responsibility, efficacy, etc.), and to analyze and develop support and substantiation.

Regulatory Counseling

Nury helps clients develop strategic approaches to evaluating and implementing corrective actions, reporting obligations and regulatory compliance. She routinely evaluates labels, product identity statements, statements of identity, ingredients, claims and substantiation. She advises on the management of foodborne illness outbreaks, adulteration, misbranding and food allergen issues, including recalls and market withdrawals, inspections, warning letters, and enforcement actions.

Nury helps clients throughout the supply chain navigate compliance with federal, state, local, and select foreign statutes and regulations. She also counsels on compliance with California’s Prop. 65.

Litigation

Nury represents clients throughout the supply chain facing consumer class action challenges, from the negotiation of pre-litigation demands to the resolution of active litigation. She also advises on supply chain management and conducts strategic reviews of contractual provisions on risk allocation, indemnification, delegation and recalls.

Nury represents clients challenging and defending advertising and marketing claims before the NAD. In addition, she represents clients with notices of violation under California’s Prop. 65.
