Federal Court Rejects Expansion of Title IX in Dismissing Claims Against Private Liberal Arts College

Title IX, negligence per se, social host liability and other state law claims made by a former student against a private liberal arts college, based on claims that the college tolerated student misuse of alcohol, were limited or dismissed in federal district court.

Faegre Baker Daniels defended the college, successfully arguing that the former student failed to state a claim under Title IX to the extent she alleged that the college unreasonably tolerated alcohol misuse that contributed to sexual assault. The court also dismissed negligence per se, social host liability and breach of contract claims asserted against the college.
